These Terms of Use are entered into by and between You and Connecticut Children’s Medical Center (“we,” “our” or “us”). Please read these Terms of Use carefully before using the Connecticut Children’s Medical Center Site (the “Site”). Connecticut Children’s Medical Center provides this Site to you subject to the following Terms of Use and Privacy Policy. If you use this Site, you agree to abide by these terms.

Connecticut Children’s Medical Center reserves the right to make changes to the Site, these Terms of Use and/or the Privacy Policy at any time, for any reason, and without notice. Information on this Site is not intended to create any physician-patient relationship, nor should it be considered a replacement for consultation with a health care professional. Intellectual Property

All content included on this Site, including text, graphics, logos, trademarks, button icons, images, digital downloads, and software is the property of Connecticut Children’s Medical Center or its third party licensor and is protected by United States and international intellectual property laws. All software used on this Site is the property of Connecticut Children’s Medical Center or its software suppliers and is protected by copyright laws. Nothing contained on this Site grants you a license or right to use any trademarks, copyrights, images or other content displayed on this Site without prior written permission of Connecticut Children’s Medical Center. Neither this Site nor any portion of this Site may be reproduced, duplicated, copied, sold, visited or otherwise exploited for commercial purposes without the express written consent of Connecticut Children’s Medical Center. You may not use any meta tags or any other “hidden text” utilizing Connecticut Children’s Medical Center’s name or trademarks without our express written consent. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to this Site so long as the link does not portray Connecticut Children’s Medical Center, its affiliates or its services in a false, misleading, derogatory, or otherwise offensive manner.

These Terms of Use permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

We will not pay you or anyone else for any information that you provide which is used by us. Additionally, you acknowledge that you have full responsibility for any such submission you make, including its legality, reliability, appropriateness, originality, and non-infringement.

Monitoring and Enforcement; Termination

We have the right to:

  • Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Site.
  • Terminate or suspend your access to all or part of the Site for any or no reason, including without limitation, any violation of these Terms of Use.

Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Site. YOU WAIVE AND HOLD HARMLESS THE CONNECTICUT CHILDREN’S MEDICAL CENTER AND ITS AFFILIATES, LICENSEES, AND SERVICE PROVIDER FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY CONNECTICUT CHILDREN’S MEDICAL CENTER/ANY OF THE FOREGOING PARTIES DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.

These Terms of Use and any dispute arising under or related to these Terms of Use (whether for breach of contract, tortious conduct or otherwise) will be governed and construed in accordance with the laws of the State of Connecticut, without regard to principles of conflict of laws.  At our sole discretion, we may require you to submit any disputes arising from these Terms of Use or use of the Site, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association.  You acknowledge that monetary damages for improper use of this Site or other breach of these Terms of Use may be inadequate. Therefore, Connecticut Children’s Medical Center is entitled to seek equitable relief in any court in the State of Connecticut, including injunctive relief against you, in addition to all other remedies.

Geographic Restrictions

The owner of the Site is based in the State of Connecticut in the United States. We provide this Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Separate Agreements

You may have entered into other agreements with Connecticut Children’s Medical Center. Those agreements are separate and in addition to these Terms of Use. These Terms of Use do not modify, revise or amend the terms of any other agreements you may have with Connecticut Children’s Medical Center.

If any of these terms shall be deemed invalid, void or for any reason unenforceable, that term shall be deemed severable and shall not affect the validity and enforceability of any remaining terms.

Indemnification

You agree to defend, indemnify, and hold harmless Connecticut Children’s Medical Center, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Site, including, but not limited to any use of the Site’s content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Site.

Waiver and Severability

No waiver by the Connecticut Children’s Medical Center of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Connecticut Children’s Medical Center to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Your Comments and Concerns

This Site is operated by Connecticut Children’s Medical Center.

We reserve the right to remove any content that allegedly infringes a third party’s copyright or otherwise violates the rights of any third party, or for any reason whatsoever, and to prohibit further use of the Site by the individuals responsible for said infringement or violation. We also reserve the right to pursue any party that submits an erroneous declaration. PRIVACY POLICY

Your privacy is important to us. This Privacy Policy describes the guidelines Connecticut Children’s Medical Center uses for protecting information you provide to us during your visit to this Site. While your individual information is protected as outlined above, we reserve the right to use aggregated, anonymous data about our visitors as a group for any business purpose, such as, without limitation, analyzing usage trends.

Other than as outlined above, Connecticut Children’s Medical Center will not sell, trade or rent your personally identifying information we may collect on this Site to any third party without your permission. Google Analytics and Google Optimize

Connecticut Children’s currently uses Google Analytics and Google Optimize to analyze the audience of the website and improve our content.  For further information, visit Google Analytics and Google Optimize.

We use Google Analytics for aggregated, anonymized website traffic analysis.  In order to track session usage, Google drops a cookie with a randomly generated ClientID in a browser.  This ID is anonymized and contains no identifiable information like email, phone number, name, etc.  Google Analytics is used to track aggregated website behavior, such as what pages are looked at, for how long, and so on.  This information is important to us for improving the user experiences and determining site effectiveness.  You can delete your cookie history and/or install the Google Analytics Opt-Out Browser Add-On.

Links to Other Sites

You should be aware that when using the Site, you could be directed to other sites that are beyond our control. For example, if you click on an advertisement or a link in a news article, you may be taken to another site. These other sites may send their own cookies to your computer, collect data, or solicit personal information from you. These other sites are not bound by the terms of this Privacy Policy.
